engaging the services of Snyder and Son Property Ventures ("Snyder and Son,"

"we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by

These Terms constitute a legally binding agreement between you and Snyder and

Saskatchewan and the surrounding area. Our Website is intended to provide

information about these services and to facilitate contact between prospective

3. PERMITTED USE OF THIS WEBSITE

 

You may use this Website for lawful purposes only. You agree not to:

 

(a) Use the Website in any way that violates applicable local, provincial,

or federal laws or regulations;

6. QUOTES AND ESTIMATES

 

All quotes and estimates provided by Snyder and Son are valid for thirty (30)

days from the date of issue unless otherwise stated in writing. Quotes are

based on site conditions, measurements, and product availability at the time

of preparation. Changes to project scope, site conditions, material

availability, product lead times, or applicable regulations may result in

adjusted pricing. Snyder and Son reserves the right to revise a quote if

material inaccuracies in the information provided are discovered after the

quote has been issued.

 

7. CONTRACTS AND PROJECT AGREEMENTS

 

No work will commence until a written Project Agreement has been signed by

both parties and any required deposit has been received. Project Agreements

will outline the scope of work, materials and product specifications, payment

schedule, project timeline, warranty information, and any applicable special

terms.

 

In the event of any conflict between these Terms and a Project Agreement, the

terms of the Project Agreement shall prevail with respect to the specific

project.

 

8. PAYMENT TERMS

 

Payment terms are as specified in the Project Agreement. Unless otherwise

agreed in writing:

 

(a) A deposit is required prior to ordering materials or commencing work,

the amount of which will be specified in the Project Agreement;

(b) Progress payments may be required at stages specified in the Project

Agreement, particularly for larger projects;

(c) Final payment is due upon substantial completion of the project;

(d) Overdue balances may be subject to interest charges at a rate of 2%

per month (24% per annum), compounded monthly.

 

Failure to make timely payments may result in suspension of work, without

liability to Snyder and Son.

 

9. PRODUCT SELECTION AND SPECIAL ORDERS

 

Many windows, doors, and siding products are custom-ordered or specially

manufactured to your specifications. Once a product order has been placed on

your behalf and confirmed in writing, cancellations or changes may not be

possible and may result in forfeiture of the deposit or additional restocking

or cancellation fees charged by the manufacturer or supplier. Clients are

encouraged to confirm all product selections carefully before signing a

Project Agreement.

 

10. CHANGES AND VARIATIONS

 

Any changes to the agreed scope of work, product specifications, or materials

must be requested in writing and approved by Snyder and Son. A written change

order will be issued outlining the impact on cost and timeline before any

change is implemented. Work on changes will not proceed until the change order

is signed and, where applicable, an additional deposit is received.

 

11. CLIENT RESPONSIBILITIES

 

You agree to:

 

(a) Provide accurate information regarding the property, existing windows,

doors, or siding conditions, and any access requirements;

(b) Ensure that Snyder and Son and its subcontractors have safe,

unobstructed access to all work areas during agreed working hours;

(c) Remove or protect personal belongings, furniture, window treatments,

and items near work areas prior to the start of work. Snyder and Son

is not responsible for damage to items not removed or protected by

the Client;

(d) Notify Snyder and Son promptly of any conditions that may affect the

work, including structural issues, the presence of hazardous materials

(such as asbestos in older siding), or other site concerns;

(e) Ensure that the property and any proposed alterations comply with

applicable municipal bylaws, zoning regulations, and condominium or

homeowners' association rules, where applicable.

 

12. PERMITS AND REGULATORY COMPLIANCE

 

Snyder and Son will perform all work in accordance with applicable

Saskatchewan building codes and regulations. Unless explicitly agreed

otherwise in writing, responsibility for determining whether a building permit

is required and for obtaining any such permit rests with the Client. Snyder

and Son is not responsible for project delays or cost increases resulting from

permitting delays or regulatory changes outside of Snyder and Son's control.

 

13. HAZARDOUS MATERIALS

 

Older properties may contain hazardous materials such as asbestos in siding,

lead paint, or other substances. It is the Client's responsibility to disclose

any known or suspected hazardous materials prior to commencement of work. If

hazardous materials are discovered during work, Snyder and Son reserves the

right to suspend work and require remediation by a qualified professional

before continuing. Any additional costs arising from the presence of hazardous

materials will be the Client's responsibility.

 

14. SUBCONTRACTORS

 

Snyder and Son may engage qualified subcontractors to perform portions of the

work. Snyder and Son remains responsible for ensuring that subcontracted work

meets the standards set out in the Project Agreement.

 

15. WARRANTY

 

Snyder and Son warrants its workmanship against defects for a period as

specified in the Project Agreement. Product and material warranties are

provided by the applicable manufacturer and are separate from Snyder and

Son's workmanship warranty. Snyder and Son will, where possible, assist

clients in understanding and accessing applicable manufacturer warranties.

 

The workmanship warranty does not cover:

 

(a) Damage caused by misuse, neglect, or failure to properly maintain

windows, doors, or siding;

(b) Normal wear and tear;

(c) Damage caused by extreme weather events, Acts of God, or external

impacts;

(d) Manufacturer defects in materials (which are covered by the

manufacturer's warranty);

(e) Damage resulting from the Client's failure to disclose known site

conditions or hazardous materials.

 

Warranty claims must be submitted in writing to [email protected]

within the applicable warranty period.

18. LIMITATION OF LIABILITY

 

To the maximum extent permitted by applicable Saskatchewan and Canadian law:

 

(a) Snyder and Son's total liability for any claim arising out of or

relating to the services shall not exceed the total amount paid by

you to Snyder and Son under the applicable Project Agreement;

(b) Snyder and Son shall not be liable for any damages of any kind

arising from your use of, or inability to use, this Website,

including but not limited to direct, indirect, incidental, punitive,

or consequential damages;

(c) Snyder and Son shall not be liable for indirect, incidental,

consequential, special, or punitive damages arising from the

provision of services, including but not limited to loss of use,

loss of income, or loss of enjoyment of property, even if Snyder

and Son has been advised of the possibility of such damages.

 

Nothing in these Terms limits or excludes liability that cannot be limited or

excluded under applicable law, including the Consumer Protection and Business

Practices Act (Saskatchewan) or other applicable consumer protection

legislation.

 

19. FORCE MAJEURE

 

Snyder and Son shall not be in breach of these Terms or a Project Agreement,

nor liable for any delay or failure to perform its obligations, where such

delay or failure results from events beyond Snyder and Son's reasonable

control, including but not limited to Acts of God, extreme weather, supply

chain disruptions, product manufacturing delays, labour disputes, or

government orders.

 

20. PRIVACY

 

Your use of this Website and your engagement of our services are also governed

by our Privacy Policy, which is incorporated into these Terms by reference.

collection, use, and protection of your personal information.

 

21. DISPUTE RESOLUTION

 

In the event of a dispute arising from these Terms or a Project Agreement,

the parties agree to first attempt resolution through good-faith negotiation.

If negotiation fails within thirty (30) days, either party may pursue

resolution through mediation or, if necessary, through the courts of

Saskatchewan.

 

22. GOVERNING LAW

 

These Terms shall be governed by and construed in accordance with the laws

of the Province of Saskatchewan and the applicable federal laws of Canada.

Any disputes arising in connection with these Terms shall be subject to the

exclusive jurisdiction of the courts of Saskatchewan.

 

23. AMENDMENTS

 

Snyder and Son reserves the right to update these Terms at any time. Updated

Terms will be posted on our Website with a revised "Last Updated" date.

Continued use of the Website or engagement of our services following notice

of any changes constitutes acceptance of the revised Terms.
